These Terms of Service (“Terms”) govern your use of summersvacationclub.com and website features operated by Joshua Martin, a sole proprietor doing business as Summer’s Vacation Club (“Summer’s Vacation Club,” “SVC,” “we,” “us,” or “our”). By using the website, you agree to these Terms. If you do not agree, do not use the website.
Website purpose
The website provides information about SVC, travel-planning services, and opportunities to request information, quotations, or assistance. Website content and submission of an inquiry do not create a client relationship, guarantee acceptance of an engagement, confirm availability, create a reservation, or complete a booking.
Specific planning, booking, payment, and travel arrangements may be governed by additional written agreements, disclosures, authorizations, invoices, supplier terms, cancellation policies, or host-agency requirements.
Eligibility
You must be at least 18 years old to submit an inquiry, enter an agreement, authorize a payment, or make a booking. An adult may arrange travel for minors and is responsible for providing accurate information and obtaining any required permissions.
Travel suppliers and host agency
SVC is an independent affiliate of A.S.A.P. Cruises Inc. Travel components are provided by independent third parties, which may include cruise lines, airlines, hotels, resorts, tour operators, destination-management companies, transportation providers, insurers, booking platforms, and other suppliers.
Suppliers are responsible for delivering their respective products and services. Supplier terms, contracts of carriage, cancellation provisions, refund rules, health and safety requirements, and privacy practices apply to the products or services they provide. Review those terms before authorizing or completing a booking.
SVC is not the owner, operator, or direct controller of independent suppliers and is not responsible for their acts, omissions, schedule changes, service disruptions, insolvency, errors, or failures, except to the extent responsibility cannot legally be excluded.
Quotes, prices, and availability
Travel prices, promotions, availability, exchange rates, taxes, fees, and supplier conditions may change without notice until a reservation is confirmed and any required payment is received and accepted. A quote is not a reservation or price guarantee unless expressly stated in writing.
You are responsible for reviewing names, dates, destinations, room categories, cabin categories, transportation, inclusions, exclusions, prices, and other booking details before authorizing purchase. Notify SVC promptly of any error.
Payments and financial information
Do not submit payment-card information through the general homepage inquiry form or ordinary email. When payment or authorization is required, SVC or the applicable supplier will provide an approved method. Payment processing and card authorization may be handled by independent providers under their own terms and security practices.
Cancellations, changes, and refunds
Cancellations, changes, credits, penalties, and refunds are governed by the applicable supplier terms and any written SVC agreement or fee disclosure. Many travel products are nonrefundable or become subject to increasing penalties as travel approaches. SVC cannot guarantee that a supplier will approve a change, credit, exception, or refund.
Planning, consultation, change, or professional fees charged by SVC, if any, will be disclosed before they are incurred and may be separate from supplier charges.
Travel protection
Travel involves financial and personal risks. Travel protection may cover certain cancellations, interruptions, delays, medical events, evacuations, baggage losses, or other events, subject to the policy’s terms, conditions, exclusions, and time-sensitive requirements. SVC recommends that travelers consider appropriate travel protection. Declining coverage may require written acknowledgment.
SVC is not an insurer and does not decide insurance claims or guarantee coverage.
Traveler responsibilities
Travelers are responsible for:
- ensuring names and traveler information are complete and accurate;
- obtaining and carrying valid passports, visas, permits, consent documents, and identification;
- confirming entry, transit, vaccination, health, customs, and security requirements;
- evaluating official travel advisories and personal health or safety risks;
- arriving on time and complying with supplier rules;
- disclosing mobility, accessibility, dietary, medical, or other needs early enough to request appropriate arrangements; and
- making independent decisions about whether travel is appropriate.
Requirements may change at any time. Governmental approval, entry, accessibility, health accommodations, or supplier exceptions cannot be guaranteed.
Accessibility requests
SVC welcomes accessibility-related requests and will communicate them to relevant suppliers when provided sufficiently in advance. Suppliers control their facilities, vehicles, staffing, and final accommodation decisions. Contact SVC before booking to discuss specific needs.
External links, direct booking, and affiliate relationships
The website may provide links or embeds for cruises, packages, tours, activities, accommodations, and other third-party services. A transaction completed on another website is governed by that provider’s terms, policies, payment process, and customer-support procedures.
SVC may receive commissions, referral fees, or other compensation when you purchase through certain links or providers. Unless stated otherwise, this generally does not increase the price you pay. Compensation does not guarantee or imply that a provider is suitable for every traveler. Material affiliate relationships will be disclosed near applicable links or content.
Website content
Website content is provided for general information and may change. Although we aim for accuracy, we do not warrant that descriptions, photographs, availability, prices, requirements, links, or other information are complete, current, or error-free. Verify material details before relying on them.
Unless otherwise identified, SVC owns or is authorized to use the website’s branding, original text, and other original content. You may use the website for personal, noncommercial purposes. You may not copy, republish, scrape, disrupt, exploit, or misuse the website or content in violation of law or third-party rights.
Prohibited use
You may not use the website to engage in unlawful, fraudulent, abusive, threatening, infringing, malicious, or security-compromising conduct; transmit malware; attempt unauthorized access; interfere with operation; submit false information; impersonate another person; or collect information about others without authorization.
Disclaimer and limitation
The website is provided on an “as available” basis. To the fullest extent permitted by law, SVC disclaims implied warranties concerning the website, including warranties of merchantability, fitness for a particular purpose, and noninfringement.
To the fullest extent permitted by law, SVC will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from use of the website or acts or omissions of independent suppliers. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.
Privacy
Our Privacy Policy explains how information is handled and is incorporated into these Terms. Third-party websites and providers apply their own privacy policies.
Changes
We may update these Terms as the website, services, providers, or legal requirements change. Updated Terms will be posted with a revised effective date. Changes do not retroactively alter a separately signed agreement unless that agreement permits it.
